Terms and Conditions

1. Contract

Tidewell Properties Ltd trading as Ocean House Tenby is the owner of the holiday let accommodation (“the Property”) and the Contract entered into which is the subject of these terms and conditions is made between Ocean House and the hirer (“the Hirer”).

2. Website

Whilst Ocean House has taken great care to ensure the accuracy of the information contained on the website or other information supplied to the Hirer relating to any services supplied, no warranty is given as to their accuracy. Ocean House does not accept responsibility for any loss or damage resulting from information given or statement made whether orally or in writing.

3. Payment

Bookings will be confirmed by Ocean House on receipt of a deposit of 30% of the total rent payable. The balance of the rental plus any security deposit is payable to Ocean House not less than eight weeks (56 days) prior to the date of commencement of the hiring. If the balance of the total rental payable together with any security deposit is not paid prior to this date, Ocean House reserves the right to cancel the booking and retain the deposit paid.

4. Reservations

If the reservation is being made within eight weeks (56 days) of the commencement of the stay then the total rent together with any security deposit is payable when the reservation is made and accepted.

5. Payments

Payments should be made to Ocean House. UK payments should be made by direct debit bank transfer, or online via the payment portal ‘Stripe’. Bank details are available on request. Bookings must be accompanied by a completed and accurate booking form.

You should receive confirmation of your booking within a few minutes of having paid online, please contact us immediately if this is not the case.

6. Cancellation and alterations to bookings.

Any cancellation must be sent to Ocean House in writing by the Hirer named on the booking form. The effective date of cancellation will be the date that the written instructions are received by Ocean House.

The cancellation fee will be 30% before 56 days of the commencement of the Let. If the cancellation is less than 56 days the fee would be the full cost of the Let.

In the event that Ocean House are able to re-let the property for the same period at the same cost, the fee and security deposit will be reimbursed to the Hirer.

Ocean House cannot accept bookings for stag or hen parties. Any such booking will result in a full refund of payment.

7. Security Deposit

A £400 security deposit is to be paid for any booking at Ocean House, which will be refunded within 48 hours following the completion of the hiring, less any charges incurred as a result of the failure by the Hirer to meet his responsibilities as set out as in conditions 10 & 11.

8.Holiday Accommodation

Ocean House is let as holiday accommodation and do not create a Landlord and Tenant relationship within the meaning of the Rent Acts.

9. VAT

Value Added Tax (VAT) is included in the rental charge where applicable.

10. Hirer Responsibilities

The Hirer is responsible for the Property during the period of rental and is expected to take reasonable care of it. All equipment and utensils must be left clean and tidy at the end of the hire period.

The Hirer is expected to leave the property in the same state of cleanliness, general repair and the order in which it was found. An additional charge may be made if extra cleaning is required.

11. Damage

Ocean House will check the condition and contents of the Property and will notify the Hirer within seven days of any additional cleaning costs or charges for damage and breakages for which the Hirer is liable. Payment shall be made by the Hirer immediately on receipt of the invoice in respect of the above charges. Where a security deposit has been taken, the charges will be deducted from the deposit and the balance refunded to the Hirer by Ocean House within 48 hours.

12. Group Bookings

Unless otherwise agreed in writing between Ocean House and the Hirer, no more than the maximum number of persons as stated on the website may occupy the Property. Admittance may be refused if this condition is not observed.

13. Revokements

Ocean House reserves the right to refuse or revoke bookings from parties which may in their opinion be unsuitable for the property concerned. In such cases all payments made will be refundable in full and the contract will be discharged.

14. Termination of Booking

The right is reserved to terminate the booking with immediate effect if the Hirer fails to observe the Rules imposed from time to time by Ocean House and in the event of termination under the provisions of this clause the Hirer will not be entitled to any refund of the hiring fee paid. The Rules are set out in the Schedule hereto and Ocean House reserves the right to alter amend or add to the Rules and conditions at any time.

15. Complaints

All complaints must be referred to Ocean House who will promptly and fully investigate the matter and ensure that corrective action is taken if the complaint is found to be substantiated. Ocean House will not entertain or consider any complaints or claims for compensation unless the complaint or problem has been raised by the Hirer in the course of the hiring or in circumstances in which it is possible for Ocean House to investigate the complaint effectively and take the necessary corrective action.

16. Liability

Whilst Ocean House makes every effort to ensure that the description of the Property is accurate and that it meets the standards set out by Ocean House, they do not accept responsibility for any alterations made to the Property or its amenities since the Particulars were prepared.

17. Damage

Ocean House does not accept responsibility for any damage, loss, additional expense or inconvenience directly or indirectly caused by the failure of its plumbing, gas, electrical or other facilities or as a result of exceptional weather conditions within the property.

18. Belongings

Ocean House does not accept any responsibility for the personal belongings of the Hirer or the Hirer’s motor car and it is the responsibility of the Hirer to arrange appropriate insurance cover in respect of these items.

19. Occupancy

The Hirer shall be entitled to occupy the Property from 4pm on the day of arrival and must vacate the Property before 10am on the day of departure unless there has been prior agreement to the contrary with Ocean House. Any variation must be clearly stated in the booking confirmation.

20. Cancellation Insurance

Cancellation insurance is not compulsory but Ocean House does strongly recommend such insurance cover to protect against cancellation penalties. Holiday insurance should be available through your own insurance brokers.

21. Right of Entry

Ocean House shall be allowed the right of entry to the Property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.

22. Special offers

No special offer can be used in conjunction with any other offer or promotion. All offers are subject to availability and our normal terms and conditions apply.

THE SCHEDULE

Rules governing the occupancy of the Property

Smoking is not permitted in the property.

Pets are only allowed in the Property or in the grounds of the Property when prior authority has been given by Ocean House. Pets are not allowed in bedrooms, on any item of furniture or to be left unattended in any property. Pets are to be kept on leads at all times within the grounds of Ocean House and it is the owner’s responsibility to clean up any soiling.

The number of occupants of the Property should not exceed the maximum number stated in the booking confirmation.

The Hirer shall not carry out any activity on the Property which might cause a nuisance or annoyance to Ocean House or the occupiers of any adjoining property and in particular (but without prejudice to the generality of the foregoing).
